What is Notary?

The notary is a member of the judiciary responsible for the administration of oaths and notarial acts within the judicial branch. In the United States, notaries are appointed by the local county court of common pleas. A notary’s duties include witnessing signatures, administering oaths, and providing notarial services. For centuries, notaries were responsible for recording official documents. They would sign the document after having witnessed its signature by a person or persons authorized by law to do so.

Today, notaries also provide notarial services, such as administering oaths and witnessing signatures, and may perform legal services as permitted by law. The use of a notary does not automatically convey legal significance to an agreement. However, a notary may be required to record certain legal instruments or acts and the notary may certify that the signer has signed as authorized by law.

What is Notary Acknowledgement?

Notary Acknowledgements are important and can be used to verify signatures and signatures on legal documents. The notary will record the name of the signer, the date the document was signed, the location where it was signed, and the signature itself.

A notary acknowledgment is a declaration by an individual before a notarial officer that:

(1) the individual has signed a record for the purpose stated in the record; and
(2) if the record is signed in a representative capacity, the individual signed the record with proper authority and signed it as the act of the individual or entity identified in the record. 

A notarial officer who takes an acknowledgment of a record shall determine, from personal knowledge or satisfactory evidence of the identity of the individual, all of the following:  

(1) The individual appearing before the notarial officer and making the acknowledgment has the identity claimed.  
(2) The signature on the record is the signature of the individual.
